Please read these terms carefully before using TalkWriter.

1. Introduction

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and TalkWriter L.L.C (“TalkWriter,” “we,” “us,” or “our”) governing your use of the TalkWriter application and related services.

By downloading, installing, or using TalkWriter, you agree to be bound by these Terms. If you do not agree to these Terms, do not use TalkWriter.

2. Privacy and Data Protection

Your privacy is fundamental to how we build TalkWriter. By using our service, you acknowledge and consent to the data practices described in our Privacy Policy.

We guarantee the following:

  • Your voice audio is processed in real-time and never stored on our servers.
  • Your transcriptions and voice data are never used to train AI models.
  • Your personal information is never sold to third parties.

3. User Accounts

You may be required to create an account to access certain features of TalkWriter. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions and Payments

  • TalkWriter offers both free and paid subscription plans. Details of each plan, including features and pricing, are available on our website and within the application.
  • Paid subscriptions are billed on a recurring basis (monthly or annually) unless cancelled before the next billing cycle.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to modify pricing with reasonable notice. Price changes will not apply to your current billing period.
  • Refund requests may be submitted within 30 days of purchase by contacting us at hello@talkwriter.ai.

5. Acceptable Use

You agree not to use TalkWriter to:

  • Violate any applicable laws or regulations
  • Infringe upon the intellectual property rights of others
  • Transmit harmful, threatening, abusive, or otherwise objectionable content
  • Attempt to reverse engineer, decompile, or disassemble the application
  • Interfere with or disrupt the integrity or performance of the service
  • Share your account credentials or allow unauthorized access to your account
  • Use automated systems or bots to access the service in an unauthorized manner

6. Intellectual Property

TalkWriter, including its design, code, features, and branding, is the intellectual property of TalkWriter L.L.C and is protected by copyright, trademark, and other applicable laws. You are granted a limited, non-exclusive, non-transferable license to use TalkWriter for personal or business purposes in accordance with these Terms.

Content you create using TalkWriter remains entirely yours. We claim no ownership over your transcriptions, text output, or any content generated through your use of the service.

7. Disclaimer of Warranties

TalkWriter is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or completely secure.

8. Limitation of Liability

To the maximum extent permitted by applicable law, TalkWriter L.L.C shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or related to your use of TalkWriter. Our total liability for any claims under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless TalkWriter L.L.C and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of TalkWriter or violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to TalkWriter at our discretion if you violate these Terms or engage in conduct that we determine is harmful to the service, other users, or TalkWriter L.L.C. Upon termination, your right to use TalkWriter ceases immediately.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TalkWriter L.L.C is registered, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting updated Terms on our website and updating the “Last updated” date. Continued use of TalkWriter after changes take effect constitutes your acceptance of the revised Terms.
